DMCA & Copyright Policy — MiraPlay

How MiraPlay handles copyright infringement claims, counter-notifications and repeat infringers.

MiraPlay respects the intellectual property rights of content creators and rights holders. We comply with the Digital Millennium Copyright Act (DMCA) and the equivalent copyright legislation applicable in Canada. This policy explains our procedures for addressing copyright infringement claims.

1. Our content licensing position

MiraPlay operates as a lawful reseller of IPTV subscription services and does not host, store or originate the content delivered through the Service. All channels and video-on-demand content are sourced from licensed content providers and distributors. We are committed to ensuring our operations respect applicable copyright law.

Subscribers are bound by the acceptable-use rules in our terms of service, which prohibit re-streaming, public display and credential sharing. How we handle personal data in the course of a copyright investigation is described in our privacy policy, and the consequences of an account being closed for infringement are set out in our refund policy.

2. Reporting copyright infringement

If you are a copyright owner or an authorised agent and believe that content accessible through https://miraplay.ca infringes your copyright, you may submit a written DMCA takedown notice to our designated agent.

Your notice must include all of the following

  1. Identification of the copyrighted work — a description of the work you claim has been infringed. Where several works are covered, a representative list is acceptable.
  2. Identification of the infringing material — the specific URL or sufficient information to locate the allegedly infringing content on https://miraplay.ca.
  3. Your contact information — full name, mailing address, telephone number and email address.
  4. Good faith statement — a statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  5. Accuracy statement — a statement that the information in your notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
  6. Signature — your physical or electronic signature.

We acknowledge receipt of valid notices within 5 business days and take appropriate action, which may include removing or disabling access to the allegedly infringing content and notifying the relevant content provider.

3. Counter-notification

If you believe content was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to [email protected].

Your counter-notice must include

  1. Identification of the removed content — description and URL of the material removed or disabled, and its location before removal.
  2. Statement under penalty of perjury — that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information — full name, address, telephone number and email address.
  4. Consent to jurisdiction — a statement that you consent to the jurisdiction of the courts in Canada and will accept service of process from the party who submitted the original notice.
  5. Signature — your physical or electronic signature.

On receipt of a valid counter-notification we forward it to the original complainant. If the complainant does not file a court action within 10 to 14 business days, we may restore the content at our discretion.

4. Repeat infringer policy

MiraPlay maintains a strict policy regarding repeat infringers. In accordance with the DMCA and applicable law in Canada:

  • Accounts that are the subject of multiple valid copyright infringement notices will be reviewed.
  • MiraPlay reserves the right to terminate the subscriptions of users determined to be repeat infringers.
  • Termination for repeat infringement does not entitle the user to a refund. See our terms of service.

5. Misuse of the DMCA process

Filing a false takedown notice is a serious legal matter. Under the DMCA (17 U.S.C. § 512(f)) and equivalent laws, any person who knowingly misrepresents that material is infringing may be liable for damages, including costs and legal fees.
